1. Acceptance of Terms

By accessing or using BuildCreditAI (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Services

The Platform provides educational tools related to credit building, personalized roadmap guidance, credit utilization calculators, informational resources, and affiliate links to third-party financial products.

We are NOT: a lender, bank, credit bureau, financial advisor, or credit repair organization.

3. Educational Purposes Only

All content, tools, and guidance are for general educational and informational purposes only. Nothing constitutes financial advice, legal advice, credit repair services, or investment advice. You are solely responsible for your financial decisions.

4. No Guarantee of Results

We do not guarantee credit score increases, approval for any financial product, or specific financial outcomes. Credit score changes depend on many factors outside of our control. Your results may vary.

5. Eligibility

The Platform is available only to individuals who are 18 years of age or older. We verify age at signup via a self-reported confirmation that you are 18 or older. By creating an account, you represent and warrant that you are 18 or older.

We reserve the right to terminate any account found to belong to a user under 18, with associated data deleted in accordance with our Privacy Policy. Any service obligations to such accounts are void.

Individuals under 18 may not create an account or use any part of the Platform. Individuals under 13 are strictly prohibited from using the Platform in any capacity.

6. User Accounts

You agree to provide accurate information, keep login credentials secure, and notify us of unauthorized account use. You are responsible for all activity under your account.

7. Subscription and Billing Terms

Free Trial: Paid plans (Builder and Pro) include a 7-day free trial. You will not be charged during the trial period. At the end of the trial your selected plan will automatically activate and your payment method will be charged unless you cancel before the trial ends.

Billing: Subscriptions are billed monthly or annually depending on the plan you selected at signup. Annual plans are billed as a single upfront payment. You authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds: All subscription fees are non-refundable except where required by law. If you cancel during a free trial before you are charged, you will not be billed. If you believe you were charged in error contact us within 7 days at [email protected] and we will review your case.

Free Plan: The free plan is available indefinitely at no charge and includes limited platform features as described on our pricing page.

Failure to pay may result in immediate suspension of paid features and downgrade to the free plan.

8. Gift Subscriptions

BuildCreditAI offers gift subscriptions through which one individual (the "Purchaser") may pay for a one-year subscription on behalf of another individual (the "Recipient"). At the time of purchase, the Purchaser selects the plan tier the gift will provide. Gift subscriptions are governed by the following terms.

8.1 Purchase and Delivery. When a Purchaser completes a gift subscription purchase, BuildCreditAI sends an invitation email to the Recipient containing a unique redemption code and a link to redeem the gift through normal account signup. The Purchaser receives a confirmation email at the time of purchase and may receive additional status communications as described in §8.7.

8.2 Redemption. The Recipient may redeem the gift by completing account signup using the provided redemption code within twelve (12) months of the purchase date. Upon successful redemption, the Recipient's account is provisioned with one (1) year of BuildCreditAI service at the plan tier selected by the Purchaser. If the Recipient already holds a paid subscription at the time of redemption, the gift period is added to the end of their existing paid period.

8.3 Refunds Before Redemption. The Purchaser may request a full refund of the purchase price within fourteen (14) days of the purchase date, provided the gift has not yet been redeemed by the Recipient. BuildCreditAI absorbs any payment processing fees; the Purchaser receives the full amount paid.

8.4 Refunds After a Recipient Declines. The Recipient may decline the gift at any time before redemption through the decline mechanism provided in the invitation email. If the Recipient declines, BuildCreditAI notifies the Purchaser, and the Purchaser may request a full refund of the purchase price within sixty (60) days of the decline notification. BuildCreditAI absorbs any payment processing fees.

8.5 Refunds After Redemption. After the Recipient has redeemed the gift, refunds are generally not available, as the subscription service has been delivered. BuildCreditAI may, at its sole discretion, provide a refund or credit in cases of demonstrable service failure or genuine hardship.

8.6 Expiration and Automatic Refund. If a gift subscription is not redeemed within twelve (12) months of the purchase date, it expires. Beginning thirty (30) days before the expiration date, BuildCreditAI will notify the Purchaser by email and provide an opportunity to extend the redemption window or otherwise resolve the unredeemed gift. If the gift remains unredeemed at the end of the twelve-month period, BuildCreditAI will automatically refund the full purchase price to the Purchaser's original payment method. The Purchaser does not need to take any action to receive this refund. BuildCreditAI absorbs any payment processing fees associated with the refund.

8.7 Status Communications. While a gift subscription remains unredeemed, BuildCreditAI may send the Purchaser periodic status updates by email, including reminders that the gift has not yet been claimed and options to resend the invitation or cancel the gift. The Purchaser may cancel an unredeemed gift at any time, in which case the refund provisions of §8.3 apply if the cancellation occurs within the applicable window.

8.8 Who May Request Refunds. Only the Purchaser may request a refund of a gift subscription. The Recipient is not the purchasing party and may not directly request a refund. Refund requests should be submitted to [email protected] with the gift subscription's transaction reference, except where a refund is issued automatically under §8.6.

8.9 Recipient Account Ownership. Following redemption, the Recipient is the sole holder of the BuildCreditAI account. The Purchaser has no right to access, modify, or receive information about the Recipient's account, except as the Recipient may voluntarily choose to share. The Purchaser's role concludes with the completed gift transaction and any associated refund.

8.10 Incorrect Recipient Information. BuildCreditAI is not responsible for gift subscriptions that fail to reach the intended Recipient due to an incorrect recipient email address provided by the Purchaser, recipient email filtering, or other circumstances outside BuildCreditAI's reasonable control. Purchasers are encouraged to verify recipient contact information at the time of purchase. A gift that does not reach its Recipient remains subject to the redemption window and automatic refund provisions of §8.6.

9. Prohibited Uses

You agree not to:

• Use the platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the platform or other users' accounts
• Scrape, copy, or reproduce platform content including roadmaps, task libraries, or educational materials without written permission
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the platform's infrastructure or servers
• Use automated tools, bots, or scripts to access the platform
• Share your account credentials with any third party

10. Intellectual Property

All content on the platform including but not limited to credit-building roadmaps, monthly task content, educational materials, tools, design, and software is the exclusive property of Averion Labs, LLC (operating as BuildCreditAI) and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for your personal, non-commercial credit-building purposes. You may not reproduce, distribute, modify, or create derivative works from any platform content without our prior written consent.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination you will lose access to your account and any data associated with it.

You may terminate your account at any time by contacting us at [email protected]. Account deletion requests will be processed within 30 days.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Averion Labs, LLC (operating as BuildCreditAI) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of the platform shall not exceed the total amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the platform shall first be submitted to good faith negotiation by contacting us at [email protected]. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration in Manatee County, Florida under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. We will notify you of material changes by email or by posting a notice on the platform at least 7 days before the change takes effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the updated Terms.
